Calling for the
Countermand Amendment Convention

The Legislature of the State of North Carolina Calls on the United States
Congress to convene the Countermand Amendment Convention under the authority
reserved to State Legislatures in Article V of the United States Constitution.
WHEREAS, Article IV, Section 4 of the Constitution of the United States
guarantees to every State a Republican form of government which gives each State
equal standing when calling for Amendment Conventions.
WHEREAS, Article V of the Constitution of the United States reserves to
the several States the right to call for an Amendment Convention for the purpose
of proposing Amendments to the United States Constitution when Congress, the
Courts, or the Executive Branch refuse to address an egregious wrong suffered by
the people; and
WHEREAS, The State Legislatures alone have the authority (as elected
Representatives of the People) to ‘Call’ on the United States Congress to
convene an Article V Amendment Convention and to ‘limit’ the agenda and
authority of Delegates they send to a convened Article V Convention. This
sovereign authority does not reside in United States Congress, nor in the
Federal or State Courts, nor in the Federal Executive Branch, nor in State
Executive Branches of government. This authority resides solely in STATE
LEGISLATURES.
WHEREAS, The United States Congress is charged by the Constitution to
facilitate the Applications from the States in an orderly and expeditious manner
and to convene the ‘Article V Countermand Amendment Convention’ when two thirds
of the Several States have completed their applications.
WHEREAS, The Countermand Amendment Convention will be a “Single Issue
Amendment Convention" defined by State Legislatures. The delegates summoned to
this convention by Congress will have the authority to deliberate on and decide
if the Countermand Amendment, as pre-approved by State Legislatures, should be
sent back to the State Legislatures for ratification. Absolutely no other
business will be authorized at this Convention; therefore, be it
Resolved by the Legislature of North Carolina
That the United States Congress convene a “Single Issue Amendment Convention”
called the COUNTERMAND AMENDMENT CONVENTION for the sole purpose to decide if
the proposed Amendment should be sent back to the State Legislatures for
ratification. Congress is directed to convene the Countermand Amendment
Convention within 60 days from the date it receives Applications from two thirds
of the Several States; and, be it
Resolved, That the Clerk forward a copy of this signed Agreement to the
leadership in Both Houses of the United States Congress.
This Article V Application directing Congress to convene the Countermand
Amendment Convention is hereby entered into and approved by the Legislature of
the State of North Carolina on this date:
