THEY ARE THE FINAL ARBITERS IN ALL CONSTITUTIONAL MATTERS.  

DELEGATE RESOLUTIONS

If State Legislatures abdicate their sovereign authority in Article V - they will not get it back. 

If the people lose their Constitution - State Legislatures will not be able to protect our Constitutional Republic.


The Constitution does not authorize "Open" Constitutional Conventions.  State Legislatures alone can Call for a “Single Issue Amendment Convention" for the purpose of proposing Amendments and to “limit” the agenda and authority of Delegates they send to a Convention.  They are the final arbiters of all Constitutional matters.  When the States Call on Congress to convene a Single Issue Amendment Convention and simultaneously enter into separate and independent Delegate Resolutions that govern the conduct of their delegates at a convened Convention, the purpose, terms, conditions, duration and text for the Amendment are predetermined.  The outcome is safe, predictable and successful. The Delegates sent by State Legislatures to a Convention are Ambassadors of their States - they are not independent agents as some have foolishly argued. 

 

Congress does not have the authority to define a “Single Issue Amendment Convention".  Congress’ authority, under Article V of the United States Constitution, requires it to convene a Convention as Called for and defined by the Several States.  Neither Congress, nor the Courts', nor the Executive Branch, have authority to restrict State Legislatures from Calling for a "Single Issue Amendment Convention" when 34 State Legislatures make their Calls. 

 

The Constitution reserves to State Legislatures the sovereign authority to "Call" for a Federal Amendment Convention for the purpose of proposing Amendments when Congress, the Courts and/or the Executive Branch refuse to address an egregious wrong suffered by the people. 

Article V  -  United States Constitution  -

"The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; . . . "

The Constitution guarantees to every State a Republican form of Government which gives each State equal standing when Calling for a Convention. 

Article IV, Section 4  - United States Constitution  -

The United States shall guarantee to every State in this Union a Republican Form of Government, . . . ”

State Legislatures can reclaim the economic and moral high ground in America.  We can reclaim our economy and Constitutional heritage through "Single Issue Amendment Conventions" one grievance at a time.  Enforcement clauses in each proposed Amendment gives State Legislatures the authority to prosecute violators of the Amendment's provisions in State Courts.  Elected officials, government workers and other individuals will have no immunity from criminal prosecution if they intentionally violate the mandates in the Amendment.  Join us in America's most critical battle for our Constitutional Republic.

COUNTERMAND AMENDMENT

ARTICLE 28 (or alternate number to be assigned by Congress)

 

Section 1.  The Article restores State sovereignty in our Constitutional Republic by providing State Legislatures Countermand authority. 

 

Section 2.  State Legislatures in the several States shall have the authority to Countermand and rescind any Congressional statute, Judicial decision, Executive Order, government agency’s regulatory ruling, or any other government mandate imposed on them when in the opinion of 60 percent of State Legislatures the law or ruling adversely affects their States’ interest.  When the Countermand threshold has been reached, the law or ruling shall be immediately and automatically nullified and repealed.  This Countermand authority shall also apply to existing laws and rulings. . . . .

SOVEREIGNTY AMENDMENT

ARTICLE 28 (or alternate number to be assigned by Congress)

 

Section 1.  The Article affirms and secures the inherent sovereign authority of United States citizens, the Constitution of the United States, the government of the United States, and the governments of the Several States.    

 

Section 2.  To secure the inherent sovereign rights of citizens of the United States the following requirements must be met:    

1.       Only citizens of the United States shall qualify to vote at any and all local, State and National elections.  Foreign residents, all non-citizens and all illegal immigrants are prohibited from voting.

2.       It is prohibited for a person born in the United States to automatically become a citizen unless at the time of birth at least one parent had been a citizen of the United States for at least 12 months. 

3.       It is prohibited for a non-citizen to be an official member of any local, State or National jury or judicial body, or to be elected to any government position, or to participate as a candidate in any election, or as an official member in any governing body.   

4.       It is prohibited for non-citizens to receive government benefits or entitlements.   An exception can be for individuals who are earning their citizenship while serving in the military or other official government service. . . . .
