TRUTH IN MEDIA AMENDMENT
ARTICLE 28 (or alternate
number to be assigned by Congress)
Section 1. It is the right of every
citizen to receive from any and all Media sources information that is not
intentionally false or intentionally misleading which is foundational to a free
people.
Section 2. The Media are all Broadcasters that disseminate information to
and for consumption by the American public. The Media includes individuals,
groups, corporations and any other type of institution or organization, whether
domestic or foreign or whether located inside or outside the United States.
Section 3. Broadcast Formats used by the Media to disseminate information
to the American public include news, entertainment, documentaries, editorials,
opinion and any other Broadcast Format that is now being used or will be used in
the future.
Section 4. Transmission Vehicles by which information is disseminated to
the American public by the Media include cable, satellite, radio, television,
airwaves, microwaves, telephone lines, print media, computers, computer disks,
video tapes, travel disks and any other device or method that is now being used
or in the future will be used to transmit information.
Section 5. To secure the rights of citizens the Media are hereby
prohibited from intentionally disseminating false information and they are
prohibited from intentionally disseminating misleading information to the
American public through any Broadcast Format or through any Transmission
Vehicle. The provisions of this Article are enforceable within the United States
which shall include the Several States, the District of Columbia, and the
Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands
and the territories and possessions of the United States.
Sections 6. Individual States shall have authority to prosecute violators
under State laws in the absence of Department of Justice enforcement.
Section 7. Congress shall have the power to enforce by appropriate
legislation, the provisions of the Article.
